Definitions:

Annex” (Personal Data Processing adn Assignment of Image Rights) means the supporting document to the Registration Form, which must be completed by the Participant and submitted to the Ria Website with the Registration Form

Competition Period” means 1 June to 30 September 2019 (inclusive)

Competition Rules” mean these competition rules related to the Competition

Registration Form” the form which must be completed and submitted to Ria by each Participant in accordance with paragraph 3 below, prior to entry to the Competition

Registration Period” means 00:01 hours on 1 June 2019 to 23:59 15 August 2019

Website” means www.riatalent.com

Promoter

The promoter for the Competition (as defined below) is Ria Financial Services Limited, 5th Floor, North Block, 55 Baker Street, London, W1U 7EU, United Kingdom. In these Competition Rules, Ria Financial Services Limited and those of its affiliates who are involved in providing Ria money remittance services, are collectively referred to as “Ria”.

Ria is the organiser of a talent festival whereby individuals apply to demonstrate their artistic skills to compete in the talent festival to win a prize in accordance with the Competition Rules (the “Competition”).  

The Competition will take place during the Competition Period.

Eligibility

The Competition is open to registered customers of Ria domiciled in the United Kingdom, who:

  • are individuals and/or groups of not more than six (6) individuals;
  • are aged eighteen (18) years or over at the time of applying for entry into the Competition. In the case of groups, each member of the group shall be at least 18 years of age at the time of applying to enter the Competition;
  • are amateurperformers, not engaged or qualified in a profession in the artistic skill, which is the basis of the Competition entry, as their main paid occupation; and
  • satisfy the “How to Enter the Competition” requirements set out in paragraph 3 below,

(the “Participant”).

Employees, officers, agents and directors of Ria and their families are not eligible to enter or win the Competition. Bulk entries from trade, consumer groups or third parties will not be eligible for entry. Professional performers are not eligible to enter or win the Competition.

How to Enter the Competition

Each Participant must:

  • complete at least one (1) relevant cash remittance order in accordance with paragraph 4;
  • go to the Website and do the following:
  • complete the Registration Form;
  • confirm your agreement to the Competition Rules, the terms of the Annex and our Privacy Policy all of which can be found on the Website; and
  • upload no more than one (1) video recording, which shall not exceed 100 MB.  
  • All Registration Forms, Annexes and video footage must be received by Ria during the Registration Period. Entries received outside of the Registration Period will not be taken into consideration in any circumstance.

Acceptance by Ria of a Participant’s entry into the Competition will be effective only when expressly communicated by Ria to the Participant in writing during the Registration Period.

Ria may refuse to accept a Participant’s entry or disqualify any Participant at any time for any reason.

Participants are deemed to have accepted and agree to be bound by these Competition Rules upon application to enter the Competition. Entry and participation in the Competition is strictly conditional on the Participant complying with the Competition Rules and the terms and conditions that apply to the relevant cash remittance order, the latter of which has been separately notified to and agreed with the Participant.

Relevant cash remittance orders

Each Participant must successfully execute a cash remittance order with Ria during the Registration Period. Participants may send money remittances with Ria via the following methods:

  • visiting Ria website: riamoneytransfer.co.uk and completing a transaction;
  • sending a money remittance through any Ria agen

For the purpose of this Competition, a relevant cash remittance order is a money remittance with Ria to a beneficiary designated by the Participant, which is initiated by the Participant and paid out to the designated beneficiary during the Registration Period.

Selection of finalists

  • National Finalists, the National Winner and the European Winner shall bear the costs of, and have sole responsibility for, obtaining adequate travel insurance, visas (as applicable) and all health/other medical requirements prior to departure. Travel (where applicable) will be subject to the airline’s standard terms and conditions. Any name, date and/or changes to the nature of the booking will not be permitted after the travel reservation has been confirmed.

Ria shall only be responsible for those expenses expressly stated in these Competition Rules.

  • National Competition

Upon conclusion of the Registration Period, a panel of judges made up of professionals from the worlds of dance, theatre and music, (the «Panel«) will shortlist ten (10) Participants (individuals and/or groups) from the pool of selected Participants (the «National Finalists«) to compete in the national final in the United Kingdom (the “National Competition”).

A list of the National Finalists will be published on the Website by Friday, 6 September 2019.

The National Final Competition will be held in Wembley, in London on [7 September] 2019. All National Finalists will perform live to the Panel and an audience, a new representation of their respective act, following which a winner will be selected by the Panel (the «National Winner«).

All National Finalists will be expected to bring to the National Competition, all and any equipment, accessories, materials or other items necessary to assist with their respective performance (“National Equipment”). Each of the National Finalists shall ensure that their National Equipment meets the necessary requirements as may be prescribed by law, regulations or protocols during transportation to and from the National Competition held in London and during the performance. Ria shall not, at any time, howsoever caused, be liable for any unlawful use, restriction or confiscation of the National Equipment, or any loss or injury caused to the National Finalist or any third party, as a result of the use or possession of the National Equipment by the National Finalists (or any third party), such liability being the sole responsibility of the National Finalist.

Ria will provide at its sole cost:

  • return passage to and from the National Competition for all National Finalists, namely by train or any other relevant means of transport,at Ria’s sole discretion;
  • food and refreshments during the National Competition,

such costs shall not exceed three hundred pounds (£300), whether the Participant is an individual or a group.

European Competition

All National Winners from across Europe will be invited to compete in the European finals, which will take place in Madrid on 29 September 2019 (the «European Competition«). A panel of judges from across Europe (the “European Panel”) will select one winner of the European Competition (the “European Winner”).

Details relating to the European Winner will be published on the Website on Monday, 30 September 2019.

All National Winners will be expected to bring to the European Competition, all and any equipment, accessories, materials or other items necessary to assist with their respective performance (“European Equipment”). Each of the National Winners shall ensure that their European Equipment meets the necessary requirements as may be prescribed by law, regulations or protocols during transportation to and from the European Competition held in Madrid and during the performance. Ria shall not, at any time, howsoever caused, be liable for any unlawful use, restriction or confiscation of European Equipment, or any loss or injury caused to the National Winners or any third party, as a result of the use or possession of the European Equipment by the National Winners (or any third party), such liability being the sole responsibility of the National Winners.

Further details regarding the requirements for the European Competition will be provided to National Winners prior to the European Competition.

Prizes

The National Winner and European Winner (irrespective of whether a group or individual) will receive one prize as follows:

  • in the case of the National Winner, a cash prize of [£3,000.00] (the “National Prize”);
  • in the case of a National Winner from the UK being chosen as European Winner, a cash prize of £8,800.00 (the “European Prize”).

The National Prize and the European Prize shall be subject to applicable tax regulations. Consequently, Ria shall deduct the necessary withholding tax applicable to the National Prize and the European Prize (as applicable).

Each of the National Winner and the European Winner hereby undertake to pay the applicable tax by reason of the acceptance of the National Prize or European Prize (as applicable).

Notification and collection of prizes

National Winner

The National Winner will be notified of his/her selection as the National Winner by email using the information provided in the Registration Form.

The National Winner shall have ten (10) days following the day of the written notification from Ria regarding the selection as a National Winner to furnish to Ria confirmation of the bank account number into which the cash prize is to be deposited, together with an official bank document that shows details of the bank account of the National Winner including:

  • IBAN code
  • BIC code
  • name of branch of the bank; and
  • name of the account holder

European Winner

The European Winner will be notified of his/her selection as the European Winner by email or telephone using the information provided in the Registration Form.

The European Winner shall have ninety (90) days following the day of the notification from Ria regarding the selection as a European Winner to furnish to Ria confirmation of the bank account number into which the cash prize is to be deposited, together with an official bank document that shows details of the bank account of the European Winner including:

  • IBAN code
  • BIC code
  • name of branch of the bank; and
  • name of the account holder

If the National Winner or European Winner (as applicable) fails to provide the requisite documentation to Ria within the time specified in these Competition Rules then the National Prize or European Prize (as applicable) will be forfeited and Ria shall be entitled (at its sole discretion) to select another winner in accordance with the process described at paragraph 5.

The National Winner and the European Winner may be subject to verification by Ria and shall be responsible for presenting valid identification document and/or information to Ria’s reasonable satisfaction, prior to receiving a National Prize or European Prize (as the case may be).

Publicity

By entering into the Competition, Participants agree:

  • to cooperate in all publicity arising from the National Prize and/or European Prize (as the case may be). If a National Finalist, National Winner or European Winner does not wish to participate in such publicity, they should inform Ria prior to accepting their respective prize;
  • Ria may notify another Participan, upon request, of the name(s) and country of a National Finalist, National Winner or European Winner provided that such request is received by Ria within sixty (60) business days after the closing date of the Competition Period; and
  • Ria, its affiliates, and any sub-contractors of Ria, may publish and use worldwide in any media, including without limitation Ria and Ria’s affiliates websites and social media accounts, the Participant’s name, video recording, picture, portrait and / or voice for advertising and promotional purposes without additional consideration, compensation, permission or notification to the Participant.

 

Data Protection

Participants shall be required to furnish Ria with personal information (the “Personal Data”) in order to participate in the Competition. Such Personal Data shall be processed by Ria for the assessment of compliance with the requirements stipulated in the Competition Rules and in accordance with Ria’s obligations under applicable data protection requirements.

Participants are required to give his/her consent pursuant to the applicable regulations. Participants must read, complete and confirm their agreement with the content of the Registration Form and the Annex. In particular, confirmation of the Participants’ explicit consent is required for Ria to use and process Personal Data for the assessment of compliance with the requirements stipulated in the Competition Rules. Refusal to furnish the Personal Data shall preclude the Participant from participating in the Competition.

The processing of Personal Data is also required for the management of the participation of the Participants, as well as that of the National Prize and European Prize. This processing is authorised by the express and informed consent conveyed by the Participant in the Annex which must be completed in order to participate in the Competition. Upon the selection of the European Winner and subject to the transfer of the applicable prize and necessary formalities, the Participant’s Personal Data shall be deleted, unless required for the management of any liability derived from the legal relationship between the Participant and Ria, in which case said Personal Data shall be duly blocked.

In the event that the Participant is selected as the National Winner or European Winner, Ria shall process the Personal Data for a period of one (1) year in the case of a National Winner and a period of five (5) years in the case of the European Winner, commencing the day after the date on which the European Competition is held. This type of processing shall be justified on the grounds of the legitimate interest of Ria as regards the requirement for the processing of the promotion of the Ria brand and participation in subsequent competitions of the same nature.

The owner of the Personal Data may exercise any rights he/she enjoys pursuant to the applicable data protection regulations on the protection of Personal Data, by sending an email to Ria’s Data Protection Officer at: dpo@euronetworldwide.com.

Image Rights

Upon signature of the Annex, the Participant expressly accepts that his/her image may be published on the Website, the Ria website, social networks, blogs and other platforms in any Competition-related promotional activity. Notwithstanding the foregoing, the Participant authorises Ria to proceed with the capture, use, publication and reproduction of his/her image with the widest authorisation, barring any legal prohibition to the contrary, provided that it is related to the Competition and is of a lawful nature. Therefore, the Participant’s image may be disseminated in any means of communication and advertising or dissemination platform, without it conferring the Participant the right of consideration or any benefit whatsoever, given that it is understood to be included in the relevant Competition prize. Ria shall not be held liable for any dissemination whatsoever which any third party may make as regards to any lawful dissemination made by Ria or on behalf of Ria. Notwithstanding the aforesaid, the Participant may revoke his/her consent at any time.

Acceptance by the Participant of the provision of this paragraph 10 provides Ria with a worldwide scope for a term of one (1) year (in the case of a National Finalist) and five (5) years (in the case of a European Winner), commencing the day after the date on which the European Competition is held for the entirety of the uses stipulated in the Competition Rules.

General conditions

The decision of Ria regarding any aspect of the Competition is final and binding and no correspondence will be entered into about it.

The National Prize and European Prize may not be substituted, assigned or transferred by the National Finalist and/or European Winner (as applicable) and no cash alternative is offered; however, Ria reserves the right to make equivalent prize substitutions if any prize becomes unavailable.

Ria reserves the right at any time and without notice to suspend or amend the Competition or Competition Rules due to events falling outside of its control (such as suspected or actual fraud).

Ria reserves the right at its sole discretion to disqualify any individual if it reasonably suspects or finds a violation of these Competition Rules or the terms and conditions applicable to the Ria money remittance service, or for any other reason (at its sole discretion).

Ria shall not bear responsibility for: any inaccurate information received from a Participant; delay in the availability of a Ria money remittance to a beneficiary; failure by the beneficiary to collect a money remittance within the Registration Period; or suspension or cancellation of a Ria money remittance order in accordance with Ria´s terms and conditions and/or laws and regulations applicable to the Ria money remittance service.  

Insofar as is permitted by law, Ria, its agents or distributors will not in any circumstances be responsible or liable to compensate any Participant (whether a National Finalist, National Winner, European Winner or otherwise) or accept any liability for any loss (whether consequential or otherwise), damage, personal injury or death occurring as a result of collecting or taking up the applicable prize except where it is caused by the negligence of Ria, its agents or that of their employees. The statutory rights of Participant’s shall not be affected.

Participants who have agreed to receive marketing communications from Ria may receive communications including but not limited to news, offers and exclusive offers in accordance with Ria’s .

Ria reserves the right to withdraw this Competition at any time without notice.

Intellectual Property

By participating in the Competition, the Participant warrants that the material submitted to Ria by the Participant (including video footage, and images) shall not:

  • contravene, violate or conflict with obligation that the Participant may have with any third party; or
  • violate or infringe any intellectual property rights of any third party.

In the event that the Participant furnishes to Ria material protected by intellectual and/or industrial property rights, he/she hereby grants Ria a worldwide, non-exclusive, transferable licence and with the option to sub-licence, without temporal or geographical limitation for public dissemination, warranting to have obtained the necessary authorisations from any third party. Notwithstanding the foregoing, the Participant shall indemnify Ria and hold Ria harmless against any and all demands, liabilities and/or claims suffered or incurred by Ria as a result of any claim by any third party which alleges that use by Ria of the materials furnished by the Participant, infringes or may infringe the intellectual property rights of that third party.

Law and jurisdiction

These Competition Rules shall be governed by English law and Participants submit to the exclusive jurisdiction of the English courts.
